法律文化缺省及翻译补偿

内容摘要

20世纪70年代,西方译介开始了翻译的“文化学转向”,法律翻译开始被视为是一种重要的跨文化交际活动,法律文化在翻译中的作用也引起了越来越多的重视。因语言与法律文化的差异,源语中缺省的法律文化成分,即作者缺省与源语读者拥有的共同法律文化背景,势必导致翻译损失。为了实现译文的可读性及交流目的,译者必须采取适当的策略,实施补偿。由于语言文化差异的存在,翻译损失从翻译活动存在就与翻译相伴。纵观中西翻译史,长久以来,很多研究者已经意识到翻译损失不可避免,翻译损失需要补偿,并有针对性地提出了不同的补偿策略。语言与文化的共性使得翻译成为可能,语言与文化的差异使得翻译存在局限,即翻译具有相对性。同构构成了翻译可译性和不可译性的基础。同构的相对性使得翻译补偿成为必须。鉴于补偿研究对翻译理论和实践的重要意义,本文将翻译补偿研究引入法律翻译,补偿法律文化缺省引起的翻译损失。本文主要关注以下几个问题:引起法律文化缺省的主要原因,法律文化缺省引起的主要翻译损失,翻译补偿研究的历史和机理,补偿原则、分类和补偿策略。法律翻译者应意识到翻译损失的客观存在,并将补偿思维贯穿整个翻译过程,有意识地采取适当的补偿策略,实施必要的补偿,以深入理解法律文化和法律语言的精髓,提高译文的可读性,实现跨文化交际的目的及法律翻译的精确性原则。
